USE OF THE WEBSITE
ACCEPTANCE OF TERMS
Your access to and use of iszy.ai ("the Website") is subject exclusively to these Terms and Conditions. You will not use the Website for any purpose that is unlawful or prohibited by these Terms and Conditions. By using the Website you are fully accepting the terms, conditions and disclaimers contained in this notice. If you do not accept these Terms and Conditions you must immediately stop using the Website.
SHARING CONTENT
These terms set out how Iszy.ai will use direct uploads of photos, text, graphics, audio, video and comments (“User Content” or “User Generated Content”) generated by you and which you have agreed that we can use. Iszy.ai reserves the right to alter these Terms without advance notice by posting a revised set of Terms on its website. Accordingly, you should review the Terms each time you upload content using Iszy.ai to stay informed of any changes to the Terms.
You warrant that the personal information which you are required to provide when you upload your content for us and our clients to use is true, accurate, current and complete in all respects. You agree not to impersonate any other person or entity or to use a false name or a name that you are not authorised to use. You will notify us immediately of any changes to the personal information you have provided us with. You are solely responsible for the content you upload to Iszy.ai. You certify to Iszy.ai that you are at least 18 years of age. If you are younger than 18, please ask your parent or legal guardian to upload the content on your behalf.
By uploading User Content you grant Iszy.ai, it’s operating parent company and Iszy.ai’s client with whom you opted to share your content (collectively, the “Licensed Parties”) the worldwide, perpetual, irrevocable, royalty-free, fully-paid, non-exclusive, transferable right to use your uploaded User Content in any manner to be determined in the Licensed Parties’ sole discretion, including but not limited to on its webpages, social media pages operated by the Licensed Parties, promotional e-mails and advertisements, and in other marketing, promotional and advertising initiatives, in any media now or hereafter known. The Licensed Parties may use, display, reproduce, distribute, transmit, create derivative works from, combine with other materials, alter and/or edit your User Content in any manner in their sole discretion, with no obligation to you whatsoever. You grant the Licensed Parties the right to use your username/handle, real name, image, likeness, caption or other identifying information in connection with any use of your User Content.
Iszy.ai reserves to right to feature any brands, companies, personalities, and miscellaneous projects, including their logos and screenshots of their use of Iszy, as case studies which may be published publicly on the Iszy.ai website, the website of Iszy.ai’s parent company and shared to social media and the wider media.
You hereby represent and warrant that (i) you own all rights in and to your User Content, (ii) if the User Content is subject to third party proprietary rights, you have all necessary licenses, rights, consents, and permissions to publish the User Content you submit and to grant the rights granted herein, including permission from all person(s) appearing in your User Content; (iii) you are legally entitled to post the User Content, and the Licensed Parties’ use of your User Content as described herein will not violate the rights, including but not limited to copyright, trademark, privacy, publicity or other proprietary rights, of any third party or any law, and (iv) the User Content is not libelous, defamatory, obscene, pornographic, abusive, indecent, threatening, harassing, hateful, or offensive.
You hereby release, discharge and agree to hold the Licensed Parties, and any person acting on their behalf, harmless from any liability related in any way to the Licensed Parties’ use of your User Content. The User Content that you submit is deemed non-confidential and the Licensed Parties have no obligation to maintain the confidentiality of any information, in whatever form, contained in any submission, except pursuant to the Licensed Parties’ respective privacy policies.
You consent to Iszy.ai’s collection of any personal information you provide, on behalf of the Licensed Parties for the Licensed Parties’ use and disclosure in connection with the use of your User Content as described herein. If you do not agree to the collection, use and disclosure of your personal information in this way, please do not upload User Content or otherwise provide Iszy.ai with personal information.
You are solely responsible for any User Content that you submit. You are legally liable for the User Content that you submit including, for example, material protected by copyright, trademark, patent or trade secret law or other proprietary rights laws without permission of the author or owner or subject featured in such submission, or defamatory comments.
The Licensed Parties reserve the right to stop using any User Content at any time, for any reason.
LIMITATION OF LIABILITY
In no event will Iszy.ai or any person or entity involved in creating, producing or distributing the User Generated Content, be liable for any damages, including but not limited to direct, indirect, incidental, special, consequential or punitive damages arising out of your User Generated Content.
USER PRIVACY POLICIES
Iszy.ai makes it possible for subscribers of the website to create forms which allow other web users to submit content and/or media. Depending on the nature of this content it's the responsibility of the creator of the form to ensure that an appropriate privacy policy is in place which complies with ICO and GDPR regulations. It is then the responsibilty of the creator of the form to respond to GDPR requests within the appropriate timeframe.

By agreeing to these terms you confirm you are above the age of 18 years old.

The Website contains photos and information uploaded by members of the public who register and upload details with iszy.ai. All copyrights for images shown are provided by the party responsible for providing the images to iszy.ai. iszy.ai cannot be held liable in any way for copyright or licensing infringements by a third party. iszy.ai can not be held responsible in any way for the contents of the Website which are uploaded by Users (“User Generated Content”). If you believe an image is being used without permission from the copyright holder, or is libelous, defamatory, obscene, pornographic, abusive, indecent, threatening, harassing, hateful, or offensive please contact iszy.ai at support@18aproductions.co.uk.

Iszy.ai makes is possible for subscribers to create customisable upload forms that accepts many types of data and media. The creators of these forms are required to have their own privacy policies in place according to the categories of data they are collecting which comply with ICO and GDPR regulations. These need to be made clear to users on the upload forms. Iszy.ai is not responsible for what our client - the organisation you share your content with - does with your information.
We do not sell, rent or exchange your personal information with any other third party without your consent for commercial reasons, beyond any essential requirement specified by law.

Your personal data uploaded via media uploads will be retained until 1) you notify us that you wish your consent to be withdrawn, 2) the media is deleted by the subscriber of the account the media was uploaded to.
The retention of your 'personal data' will be subject to periodic review.
